the vehicle is in the "down" position but my husband has been driving it. He just noticed the tops of rear tires on both sides tipping in today and I just wanted to know if he should still be driving it

No, you don't want to drive the vehicle indefinitely. It should only be driven a short distance at a lower speed to a repair facility, if you're unable to diagnose and repair the problem yourself.
