Since the repair cost was not at or above 75% of the retail value. It will not be totaled and sent to the scrap yard. You could get a 2nd opinion on the vehicle's repair cost to see if it should have been tottaled. You may need to seek an attorney since the bank is coming after you for money when you had gap insurance.
